Prezenta lucrare reprezintă prima traducere completă și metodologică, în limba engleză, a Codului penal român. Aceasta este elaborată pe baze metodologice riguroase, fiind realizată cu scopul de a spori accesibilitatea dreptului penal român într-un peisaj juridic din ce în ce mai interconectat. Destinată practicienilor dreptului, cadrelor universitare, cercetătorilor, studenților, instituțiilor internaționale și companiilor care își desfășoară activitatea în mai multe jurisdicții, lucrarea urmărește să faciliteze cercetarea juridică comparată, cooperarea judiciară și o înțelegere mai profundă a substanței dreptului penal român dincolo de granițele sale naționale.
Într-o eră tot mai puternic marcată de inteligența artificială (IA), însăși necesitatea traducerii juridice realizate de profesioniști ai dreptului poate părea discutabilă. Totuși, limbajul juridic este cu mult mai mult decât simple cuvinte. Este expresia vie a unor concepte, instituții și tradiții juridice înrădăcinate în culturi juridice distincte. A-l traduce cu fidelitate presupune nu doar competență lingvistică, ci și capacitatea de a înțelege, interpreta și conecta concepte juridice aparținând unor sisteme de drept fundamental diferite. Instrumentele bazate pe IA pot sugera echivalențe lingvistice, însă nu pot oferi precizia conceptuală, rigoarea terminologică și profunzimea juridică pe care doar raționamentul unui profesionist experimentat le poate garanta.
Într-un domeniu în care sensul juridic poate depinde de precizia unui singur termen, acuratețea este esențială. Lucrarea de față este construită în jurul acestui principiu.
Această traducere a Codului penal român adoptă o metodologie orientată spre sens, care acordă prioritate substanței juridice a fiecărei dispoziții în detrimentul echivalenței lingvistice literale. Valorificând doctrina juridică românească, instrumentele juridice europene și internaționale, sursele de drept comparat, jurisprudența internațională și traducerile oficiale ale codurilor penale străine, am urmărit să asigurăm coerența terminologică, acuratețea și fidelitatea față de conceptele juridice subiacente. O atenție deosebită a fost acordată conceptelor specifice dreptului penal român, pentru care nu există întotdeauna echivalente directe în alte sisteme de drept.
Prin facilitarea accesului comunității juridice internaționale la legislația penală română, acest proiect își propune să contribuie la dialogul juridic transfrontalier, să consolideze analiza juridică comparată și să promoveze o înțelegere mai amplă a dreptului penal român în contextul juridic global.

Translating it faithfully demands not just linguistic skill, but the capacity to grasp, interpret, and bridge legal concepts across fundamentally different systems of law. AI tools can suggest linguistic equivalents, but they cannot deliver the conceptual precision, terminological rigor, and legal depth that only the judgment of experienced legal professionals can guarantee. In a field where legal meaning may hinge on the precision of a single term, accuracy is essential. This volume is built on that principle.
This translation of the Romanian Criminal Code adopts a meaning-oriented methodology that prioritizes the legal substance of each provision over literal linguistic equivalence. Drawing on Romanian legal scholarship, European and international legal instruments, comparative law sources, international case law, and official translations of foreign criminal codes, we sought to ensure terminological consistency, accuracy, and fidelity to the underlying legal concepts. Particular attention has been paid to concepts specific to Romanian criminal law, for which direct equivalents are not always available in other legal systems.
By making Romanian criminal legislation more accessible to the international legal community, this project aims to contribute to cross-border legal dialogue, enhance comparative legal analysis, and promote a broader understanding of Romanian criminal law in the global legal arena.
